Terms of Service
Effective date: October 28, 2026
These Terms of Service and Sale ("Terms") apply when you use formyq.com or buy 3D printing, design or related services from FORMYQ. FORMYQ is a Michigan-based business ("FORMYQ", "we", "us"). By requesting a quote, placing an order or creating an account, you agree to these Terms. If you're ordering for a business, you confirm you're authorised to accept them for that business.
Related policies form part of these Terms: the Privacy Policy, Shipping & Returns, Acceptable Use Policy, Design Services, IP & Confidentiality Terms, the Business Terms for business accounts, the Cookie Notice and the Materials Expert (AI) Terms.
1. What we do
FORMYQ is a small FDM (fused deposition modelling) 3D printing and product development studio in Michigan. We print on QIDI Max4 and Plus5 printers in the materials listed on our Materials page, offer CAD and product design, and ship worldwide except to destinations we can't legally serve.
2. Quotes are not orders
- Every request is reviewed by a person. Automated size checks, instant estimates and the AI Materials Expert are guidance only — they are not quotes.
- A quote lists the parts, material, quantity, finish, price, shipping and any other charges, and is valid until the date shown on it. After that date we may need to re-check pricing and capacity.
- A quote becomes a confirmed order only when you accept it and we receive any payment the quote requires (full payment or a deposit). Until then either of us can walk away.
- We may decline any request, before or after quoting, including for reasons in our Acceptable Use Policy. If we decline after you've paid, we refund what you paid for that work.
- Obvious errors (for example a mistyped price or quantity) can be corrected before work starts; if the correction changes the price, you can accept the corrected quote or cancel for a full refund.
3. Prices, payment and taxes
- Prices are in US dollars. Payments are processed by Stripe; we never see or store your full card number. Your bank may charge currency conversion fees.
- Unless your quote says otherwise, payment is due before production starts. Some orders require a deposit, with the balance due before shipping; your quote and invoice show which.
- Prices don't include taxes, import duties, VAT/GST or customs fees unless the quote says so. Where we're required to collect a tax, it will be shown before you pay. Charges collected by customs or a carrier on import are paid by the recipient (see Shipping & Returns).
- Business accounts may have other payment terms only if agreed in writing (see Business Terms).
4. Your files and information
- You confirm that you own, or have permission to use, every file, drawing, photo and specification you send us, and that making the part doesn't infringe anyone's patent, copyright, trademark, design right or trade secret, or break any law.
- You keep ownership of your files and designs. You give us a limited licence to store, view, slice, modify (for printability, with your agreement for anything beyond routine preparation) and print them only to quote and fulfil your order and to keep business records.
- Files are stored privately and shared only with the people at FORMYQ working on your project and the service providers listed in our Privacy Policy. We never publish your work without your written permission.
- You agree to compensate us for reasonable costs, damages and legal fees we incur because of a claim that a file or design you provided infringes someone else's rights or breaks the law, except to the extent the claim is caused by our own changes or conduct.
5. What FDM printing can and can't do
3D printed parts are made layer by layer. Please read the Filament Guide for each material's strengths and limits. In particular:
- Parts have visible layer lines and small surface marks where supports were removed. Colour can vary slightly between batches and spools.
- Dimensional accuracy depends on geometry, size, orientation and material. Unless a tolerance is written on your quote as agreed, we don't guarantee specific tolerances or fits. Typical FDM accuracy is a few tenths of a millimetre and can be more on large or warping-prone parts.
- Printed parts are weaker between layers than along them, and datasheet values come from ideal test samples. Real-world strength, heat and chemical resistance depend on your design and use.
- We don't certify any printed part for food or drink contact, medical use, child safety, flammability, pressure, load-bearing safety or any regulated use. You're responsible for deciding whether a part is suitable for your purpose and for testing it.
6. Our promise (limited warranty)
We promise that parts we ship will (a) be made in the material and colour stated on your order, (b) match the approved file and the specifications written on your quote within the limits above, and (c) be free from print defects that make them unusable for a normal purpose of that part (such as delamination, missing features or serious warping).
If a part doesn't meet that promise and you tell us within 14 days of delivery (see Shipping & Returns), we'll reprint it or refund the affected items — our choice, acting reasonably — and cover the return shipping if we ask for the part back. That is our promise and your remedy for defects.
Except for this promise and any rights you have that can't be excluded by law, parts and services are provided "as is", and we don't make other warranties, including implied warranties of merchantability or fitness for a particular purpose, unless we agree a specific fitness-for-purpose requirement in writing on your quote.
7. Inspection, reprints and remakes
- Please inspect parts promptly. Report problems within 14 days of delivery with photos and your order reference to support@formyq.com.
- Parts that match the approved file and quote aren't defective just because the design needs changing — design changes, new revisions and fit adjustments are new work and are quoted separately.
- If a print fails during production, we reprint at our cost before shipping. You won't be charged extra for our failed prints.
8. Changes and cancellations
- You can cancel for a full refund until we start production (for example, before we approve your file for printing or buy materials specifically for your order).
- After production starts, you can cancel by telling us in writing; we'll refund what you paid minus the reasonable cost of work already done and materials bought for your order, and send you any finished parts if you'd like them.
- Design work already completed, and custom parts already made to your specifications, are generally not refundable except under Section 6.
- We may cancel an order if we can't make it as quoted (for example, a material becomes unavailable or a part can't be printed reliably). We'll offer an alternative or a full refund for anything not delivered.
9. Shipping and delivery
Shipping methods, risk, damage claims and international duties are covered in Shipping & Returns. Estimated dates are estimates, not guarantees.
10. Accounts
Keep your sign-in details secure and tell us at support@formyq.com if you think someone else has used your account. You're responsible for activity on your account. We may suspend accounts used to break these Terms or the law.
11. Limitation of liability
To the extent the law allows:
- We aren't liable for indirect, incidental, special or consequential losses, such as lost profits, lost business, production downtime or the cost of substitute goods, even if we knew they were possible.
- Our total liability for any claim relating to an order is limited to the amount you paid for that order.
- We aren't responsible for problems caused by your design, files or specifications, by misuse, modification, normal wear, or use outside the limits described for the material, or by events beyond our reasonable control (such as carrier delays, customs holds, power or internet outages, severe weather or supply shortages).
Nothing in these Terms limits liability that can't legally be limited, including for death or personal injury caused by negligence, fraud, or rights you have under consumer protection laws that can't be waived.
12. Resolving problems
We'd rather fix a problem than argue about it. If something goes wrong, email support@formyq.com with your order reference and we'll respond and try to resolve it within 30 days.
If we can't resolve it informally, either of us may bring a claim in the small claims division of the district court where FORMYQ is based, if the claim qualifies, or otherwise in the state or federal courts located in Michigan. These Terms are governed by the laws of the State of Michigan and applicable US federal law, without regard to conflict-of-law rules. If you're a consumer living outside the US, you also keep any protections of your local law that can't be excluded by agreement.
13. Changes to these Terms
We may update these Terms. The version in effect when you accept a quote applies to that order. We'll change the effective date above and, for significant changes, tell account holders by email.
14. Everything else
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer your rights under these Terms without our written consent. A signed written agreement between you and FORMYQ (such as a supply agreement) takes priority over these Terms where they conflict.
